Under the current legislation, if your debtor has been in default for more than 60 days and the amount of debt is at least PLN 500, you can report such debtor’s details to the ERIF Register of Debtors.
No court order is required; a proof of existence of the debt (invoice, bill) is enough. Your only duty is to inform the debtor in advance about the intention to report his data– for this reason we are providing you with a template of a demand for payment including a special warning. Then, after logging into the ERFI Register of Debtors system, you will only have to fill out an electronic form with debtor details (such as e.g. NIP) as well as with information about the debt. From that moment on, your debtor data will be accessible to other providers of products and services in Poland and in the rest of the EU. The system is accessible via the Internet and checking the details of the selected company takes only a few seconds. Full information about your debtor (debt amount, due date of payment, etc.) will be displayed on the screens of computers of all those who have entered the NIP number of your debtor.
By reporting debtor details to the system you not only provide better motivation for bad payers but also warn other participants in the market – that is the idea of credit information exchange.
